The Madrid Protocol in Indonesia:Enhancing International Trademark Protection While Upholding the Essential Role of Local IP Consultants

The Madrid Protocol is an international system administered by WIPO that allows trademark owners in Indonesia to register their marks internationally with a single application through the Directorate General of Intellectual Property (DJKI), simplifying and reducing costs compared to filing separately in each country.

Indonesia joined the Madrid Protocol in 2018, enabling local businesses to protect their trademarks in multiple member countries more efficiently and encouraging Indonesian brands to compete globally. The system offers advantages such as one language, one currency, and one administrative process for multiple countries, which supports Indonesia’s economic integration and investment climate.

Despite these benefits, using local IP consultants remains necessary because:

  • Consultants have expertise in navigating Indonesia’s specific substantive examination and administrative procedures, ensuring proper filing and compliance with local laws.

  • In cases of opposition, refusal, or rejection of international trademark applications, local consultants are essential to respond and manage legal processes within Indonesia.

  • Local consultants help handle complexities beyond the streamlined Madrid process, including maintaining registrations, renewals, and enforcement actions domestically.
